These Terms and Conditions (“Terms”) govern your access to and use of the websites, applications, and online services operated by Mudge Fasteners, Inc, a business unit or division of OneMonroe (collectively, the “Sites”). By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, you should not use the Sites.

Scope of These Terms

These Terms apply to all visitors, users, and customers of the Sites, including marketing websites, eCommerce platforms, and quote or order submission tools. Additional terms may apply to specific products, services, or transactions.

Use of the Sites

You may use the Sites for lawful, informational, and business purposes only. You agree not to:

  • Violate any applicable laws or regulations

  • Submit false or misleading information

  • Interfere with the operation or security of the Sites

  • Attempt unauthorized access to systems or data

Products, Orders, and Transactions

All product descriptions, pricing, and availability are subject to change without notice. Submission of an order or request does not constitute acceptance. Mudge Fasteners, Inc reserves the right to accept, reject, or cancel any order at its discretion.

Minimum Order

  • $150.00 minimum Order

  • $5.00 minimum line item

Quotation Validity

  • Price quotations are valid at the time they are submitted and may become invalid if the quoted merchandise is no longer available at time of order.

  • Price quotations are made based on product availability.

Availability

  • All merchandise is subject to prior sale.

    • Prices are subject to change if quoted merchandise has been sold.

  • Carton quantities are subject to change.

Will Call 

  • Will Call orders will be paid for by Credit Card at time order is placed unless Net 30 terms are previously established.

  • Will Call orders will be held for 7 days after which time order will be cancelled or shipped to the customer.

Payment

  • Net 30 terms available upon approval.

    • Net 30 accounts will be reviewed after one year of inactivity

  • Company checks are accepted from established accounts.

  • We accept: Visa®, Mastercard®, American Express® and Discover® on new and existing balances.

  • We do not keep cash on the premises and cannot process cash payments. 

Credit Hold

  • Accounts with a balance over 45 days will placed on credit hold

  • Accounts with a balance over 60 days will be subject to collection action and revocation of Net 30 terms

Returns

  • All parts must be in original packaging.

  • Discrepancies

    • Mudge Fasteners must be notified within 5 business days after receipt of product

    • Defective or incorrectly shipped merchandise returned promptly to Mudge Fasteners will be replaced or the purchase price refunded.

  • RMA

    • Return Merchandise Authorization (RMA) must be issued by Mudge Fasteners prior to return.

      • RMA is valid for 10 days

      • Customer is responsible for the cost or delivery of the return freight except in cases of error on the part of Mudge Fasteners.

  • Returns for Credit

    • Merchandise must be in as-received condition and in original packaging

    • Returns may be subject to a restock fee starting at 15%

  • NCNR

    • Special order, non-standard, modified or Made-To-Order items are Non-Cancellable and Non-Returnable.

  • Warranty

    • Mudge Fasteners makes no warranty of fitness for merchantability or any particular purpose.  We are not responsible for consequential or any other damages.

Customer Credits

  • Unused customer credits will expire after 1 year.

Intellectual Property

All content, materials, graphics, software, and trademarks on the Sites are owned by Mudge Fasteners, Inc or its licensors and are protected by applicable intellectual property laws. No content may be copied, reproduced, distributed, or used without prior written permission.

Third-Party Links

The Sites may contain links to third-party websites not controlled by Mudge Fasteners, Inc. We are not responsible for the content or practices of those sites.

Disclaimer of Warranties

The Sites and all materials are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Mudge Fasteners, Inc shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your use of the Sites.

Indemnification

You agree to indemnify and hold harmless Mudge Fasteners, Inc and its affiliates from any claims, damages, or expenses arising from your use of the Sites or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. Changes will be effective when posted. Continued use of the Sites constitutes acceptance of the revised Terms.
